Проблемы правового регулирования долевого участия в строительстве в Российской Федерации

Abstract

В статье исследованы проблемы правового регулирования долевого участия в строительстве в Российской Федерации. Проанализирована правовая природа договора долевого участия в строительстве, определенны его стороны и существенные условия. Выявлены проблемы правового регулирования данной сферы, изменения, вносимые в законодательство в целях решения этих проблем, предложены меры по их дальнейшему решению.

This article examineы the problems of legal regulation of equity participation in construction in the Russian Federation. For this purpose, the main law regulating legal relations in this area was considered, this is the Federal Law of December 30, 2004 No. 214-FZ “On participation in shared construction of apartment buildings and other real estate and on amendments to certain legislative acts of the Russian Federation”. The legal nature of this agreement was considered. The following are defined: the subjects of this agreement, the essential terms of the agreement. The changes made to this law were reviewed, problems of legal regulation in this area were identified and measures were proposed to solve them.
