Традиции и новации советского законодательства по укреплению трудовой дисциплины в 1938–1940 гг.

Abstract

В статье изучена проблема преемственности и новизны в содержании нормативно-правовых актов 1938 г. и 1940 г. и их правоприменительной практики при регулировании вопросов трудовой дисциплины и текучести кадров на производстве. Показана эволюция содержания понятия «прогул», рассмотрены изменения в перечне санкций за нарушения трудовой дисциплины. На этом основании сделан вывод, что анализируемые нормативно-правовые акты 1938 г. и 1940 г. преследовали одинаковые цели, последовательно развивали одни и те же тенденции в правотворческой деятельности. Однако Указ от 26 июня 1940 г., вынужденно ставший ответом на низкую эффективность предшествующей политики по укреплению трудовой дисциплины и снижению текучести кадров, изменил приоритет в методах регулирования данных правоотношений и заложил основу для новой законодательной базы.

The article discusses the role of tradition and new trends in legislative and regulatory compliance practices associated with the two legal acts of 1938 and 1940, which were intended to reduce the economic impact of industrial staff absenteeism and turnover. The article explores the development of the concept of ‘progul’ (unauthorized absence at work) and the changes in the sanctions against breaches of the labour discipline. Thus, a conclusion is made that these legal acts pursued similar goals and consistently developed the same trends in lawmaking. By the late 1930s, the conditions on the labour market had changed (there was an excess of demand over supply) and the old methods of retaining employees had proven to be inefficient. Implementation of the legal act of 1938 led to an increase in the number of breaches of labour discipline and to an increase in the staff turnover. The managerial personnel resisted the regulatory practice introduced by this legal act. The author shows that the Decree of 26 June 1940 was necessitated by the low efficiency of the previously applied policy and changed the government’s priorities in the regulation of labour discipline. This Decree thus laid the foundation for the new legislative framework.
